JUSTICE BIRENDRA KUMAR ORAL ORDER 29-05-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420/34 of the Indian Penal Code.

According to the FIR, on the report and recommendation of the petitioner, who was Panchayat Secretary of Gram Panchayat, Babhani and the local Mukhiya, amount of Indira Awas was sanctioned and disbursed to the beneficiaries without verifying their land.

Subsequently beneficiaries constructed their houses on some different land and not on the land shown by them as their own. Therefore, submission is that in fact no local reporting was done there on behalf of the petitioner

Patna High Court Cr.Misc. No.28745 of 2018 (3) dt.29-05-2018 2/2 and considering the merit of this case the B.D.O. was allowed anticipatory bail by a coordinate Bench of this Court in Criminal Miscellaneous No. 51186 of 2017 and another co-accused has also been allowed bail in Criminal Miscellaneous No. 54699 of 2017. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Dagarwa Police Station Case No. 136 of 2017 (GR No. 2961 of 2017), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
