ANJANA MISHRA ORAL ORDER 08-10-2015 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner Pramod Kumar is apprehending his arrest in connection with Kajra P.S.Case No. 33 of 2015 registered under Sections 313, 376/34 of the IPC and Sections 3(x)(i) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Learned counsel for the petitioner submits that save and except the fact that the petitioner is the brother of the main accused Mukesh Kumar Prabhakar there is no allegation against the petitioner and that he has been falsely implicated in the present case. It is further submitted that other family members of the petitioner, who are also similarly placed, have been extended to

Patna High Court Cr.Misc. No.29826 of 2015 (3) dt.08-10-2015 the privilege of anticipatory bail in Cr.Misc.No. 28775 of 2015 vide order dated 23.7.2015 and the said Mukesh Kumar Prabhakar has also been released on regular bail vide order dated 27.7.2015 passed in Cr.Misc.No. 26530 of 2015.

Considering the aforementioned facts and circumstances and that there is no particular allegation attached to the petitioner, let the petitioner, above named, in the event of his arrest/surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each in connection with Karja P.S.Case No. 33 of 2015 to the satisfaction of the S.D.J.M. (West) Muzaffarpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
