2. The petitioner is seeking regular bail in connection with Laxmipur P.S. Case No. 544 of 2023 for the offences punishable under Section 392 of the Indian Penal Code.

3. As per allegation, some unknown accused persons opened the dikki of motorcycle of the informant and took away cash, Samsung Tab, bio-metric machine and mobile phone etc.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that the petitioner was not arrested at the spot. Nothing was recovered from his possession. He has also submitted that except the confessional statement of the co-accused Nitish Kumar there is nothing against the

Patna High Court CR. MISC. No.58052 of 2024(4) dt.21-01-2025 2/2 petitioner. He has next submitted that till date no TIP has been conducted. The petitioner is under custody since 04.04.2024.

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Laxmipur P.S. Case No. 544 of 2023, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
