JUSTICE AJIT KUMAR ORAL ORDER 08-10-2025 Heard Mr. Abhishek Kumar, learned counsel for the petitioner, learned counsel for the informant-Opposite Party No. 2 and learned Additional Public Prosecutor for the State.
2. The petitioner apprehends his arrest in connection with Trial No. 2732 of 2024 arising out of Complaint Station Case No. 2498 of 2023 registered for the offences punishable under Sections 498A/341/323/504 of the Indian Penal Code.
3. Earlier on 27.06.2025 on the request of the parties, the matter was sent to Mediation and Reconciliation Center, Patna High Court, Patna. Accordingly, the Mediator's report dated 22.08.2025 kept on record goes to show that despite best and sincere efforts, the dispute between the parties could

At this stage, learned counsel for the petitioner submits that without prejudice to the right and contention of the petitioner and in order to maintain Opposite Party No.2 and the issues can be given a quietus by the intervention of court, the petitioner is ready and willing to pay a sum of Rs. 5000/- per month to the Opposite Party No. 2 as living cost in addition to Rs. 30,000/- at one go within one week subject to the final outcome of the present case as well as the matrimonial case pending between the parties, if any.

On the other hand, learned counsel for the informant-Opposite Party No. 2 accepts the offer so made by learned counsel for the petitioner and submits that the petitioner may be directed to deposit Rs. 30,000/- at one go within one week as well as the amount of Rs. 5000/- per month in the bank account of the informant-Opposite Party No. 2, details of which shall be furnished by learned counsel for the Opposite Party No. 2 to learned counsel for the petitioner within one week from today.
6. After having heard learned counsel for the parties and taking into consideration the materials on record and
Patna High Court CR. MISC. No.38777 of 2025(3) dt.08-10-2025 3/3 the fact that the offer made by learned counsel for the petitioner has been accepted by learned counsel for the Opposite Party No. 2, this Court is inclined to grant the petitioner privilege of anticipatory bail.
7. This application for anticipatory bail is, accordingly, allowed.
8. Let the petitioner, above named, in the event of his arrest/surrender before the learned trial court within a period of four weeks from today, be released on bail, upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sadar Motihari, East Champaran in connection with Trial No. 2732 of 2024 arising out of Complaint Station Case No. 2498 of 2023.
9. This is subject to the condition that the petitioner shall deposit a sum of Rs. 30,000/- at one go within one week as well as the amount of Rs. 5000/- per month in the bank account of the informant-Opposite Party No. 2 positively, starting from 10th of October, 2025.
