Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.
Allegation of firing and of causing firearm injury is against other named accused persons. Allegation of conspiracy is against the named accused persons. Petitioner is not named in the F.I.R.
Submission of the petitioner is that on suspicion the petitioner has been implicated in this case. Learned counsel for the informant opposed the prayer on the ground that the petitioner is named in seven criminal cases which are disclosed in para 3 of the petition. Considering the material against the petitioner in
Patna High Court Cr.Misc. No.42586 of 2016 (3) dt.13-12-2016 this case, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa/Successor Court in connection with Bihra P.S. Case No. 57 of 2016.
