Petitioner, who is in custody since 25.10.2015, seeks bail in connection with Barhara (Raghubansh Nagar) P.S. Case No.251 of 2015 registered for the offences punishable under Sections 376 and 511 of the Indian Penal Code and Section 8 of the POCSO Act.
Allegation against the petitioner is that he made an attempt to commit rape on the niece of the informant. Petitioner was arrested on the spot by the police.
Learned A.P.P. appearing on behalf of the State submits that the charge-sheet has already been submitted and cognizance has been taken against the petitioner under Sections
Patna High Court Cr.Misc. No.19749 of 2017 (3) dt.19-05-2017 376/511 of the Indian Penal Code and Section 8 of the POCSO Act.
Considering the aforesaid facts as well as nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail in connection with Special Case No.60 of 2015, arising out of Barhara (Raghubansh Nagar) P.S. Case No.251 of 2015, pending in the court of learned 1st Additional Sessions Judge-cum-Special Judge, Purnea is rejected. However, the learned court trial court is directed to expedite the trial and conclude the same within a period of six months from the date of receipt/production of a copy of this order.
