Mr.Vinod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 05-07-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Civil Line P.S. Case No.176 of 2019 registered under Sections 147, 148, 149, 323, 341, 504, 506, 448, 379, 307 and 354(B) of the Indian Penal Code.

The accusation is that the petitioners, who are neighbours of the informant Shanti Devi, in the evening of

No.41223 of 2019(2) dt.05-07-2019 2/3 19.04.2019, having bricks, stones and lathi in their hands entered into the house of the informant and started to commit 'Maar-Peet' and tried to unfold her Saree. Thereafter, Amar Manjhi (petitioner no.2) caused blood oozing injury at the forehead of the informant through lathi and Suraj Manjhi (petitioner no.1) with bad intention unfold her Saree. In that course, Karan Manjhi (petitioner no.3), Puniya Devi (petitioner no.4), Pachiya Devi (petitioner no.5) and Moti Manjhi (petitioner no.6) assaulted the informant by catching her hair. Moti Manjhi (petitioner no.5) also took Rs.2700/- of the informant. The cause of occurrence is that Amar Manjhi (petitioner no.2) wanted to perform his marriage with Sumanti Kumari, the niece of the informant, but the informant had refused the same saying that she has settled her marriage at another place.

Learned counsel for the petitioners submits that due to some dispute, the scuffle took place in between the parties but due to ulterior motive, the informant has lodged the present case. The petitioners have no criminal antecedents.
