JUSTICE SANJAY PRIYA ORAL ORDER 12-01-2017 Heard learned Counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offence under Section 22 (B) of N.D.P.S. Act. It is alleged that 60 grams of ganja has been recovered from the plastic bag kept in the Gumti which is alleged to have been in possession of the petitioner.

It has been submitted that as per Government Notification, up to 1 kg. of ganja will come under small quantity. The maximum punishment of holding small quantity is up to six months, or with fine, which may extend to 10,000/- rupees or with both in terms of Section 20 of NDPS Act. It has been stated that the petitioner is in custody since 25.8.2016. Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on

No.877 of 2017 (2) dt.12-01-2017 2/2 furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge I cum Special Judge, NDPS Act, Begusarai, in connection with NDPS Case No. 16 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
