The petitioner seeks regular bail in connection with Belchhi (Belchi) P.S.case nO.32 of 2016 registered for offences punishable under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code.

Allegation against the petitioner is of manipulation in the BETET mark-sheet and obtaining employment on the basis of that.

Submission of the learned counsel for the petitioner is that as a matter of fact in the mark-sheet which has been supplied to him there was no marks mentioned against paper- 1 and as such the petitioner has no knowledge about the same. He is in custody

Patna High Court Cr.Misc. No.35490 of 2018 (4) dt.31-10-2018 2/2 for three months. Now the charge has also been framed in this case.

Heard learned counsel for the Vigilance who has opposed the prayer for bail..

Having heard both sides and considering the fact that now the charge has been framed as such, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Barh in connection with Belchhi (Belchi) P.S.case No.32 of 2016 dated 13.7.2016. With following conditions :

(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and in the event of failure to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bond.
