The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code. The prosecution case in short is that the accused persons including the petitioner assaulted the informant and his sons by means of Lathi, spear and Farsa, as a result of which, injury was sustained by the informant.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 01-03-2019. Charge sheet has already been submitted. There is case and counter case between the parties. Free fight is alleged to have taken place between the

Patna High Court CR. MISC. No.38252 of 2019(2) dt.24-06-2019 2/2 parties. The injury on the side of the accused has not been explained by the prosecution. The prosecution has not come with clean hands.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No. 37 of 2019.
