The petitioners apprehend their arrest in connection with Madhepura (Ghailarh O.P.) P.S. Case No.494 of 2016/G.R. Case No.1340 of 2016 registered under Sections 147, 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code. The accusation is that at the time of repairing of the house of the informant, the petitioners and one Shankar Yadav reached there and the petitioner Satto Yadav through Dabia and the petitioner Sandeep Yadav through rod caused injury at the head of the informant whereas the petitioner Ganesh Yadav through lathi
Patna High Court Cr.Misc. No.52835 of 2016 (2) dt.06-12-2016 2/2 caused injuries at the back, arms and leg of the informant. Learned counsel appearing on behalf of the petitioners submits that, in fact, due to land dispute, the occurrence of "MaarPeet" took place in between the parties in which the informant and the petitioners' side also sustained injuries but due to ulterior motive, the informant has lodged this false case. Moreover, the injuries, as found on the person of the informant, are simple in nature. The petitioners have no criminal antecedents. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhepura, in connection with Madhepura (Ghailarh O.P.) P.S. Case No.494 of 2016/G.R. No.1340 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
