2. Petitioner seeks regular bail in connection with Rajpur P.S. Case No.194 of 2024 registered under Sections 302 and 120(B)/34 of the I.P.C.
3. It is alleged that the informant's son had gone to the pond to feed the fish but he did not return and as the call was also not answered, they started searching and found his dead body, as she had reasons to believe about the conspiracy theory of Sonamati Devi with her son-in-law Chhathhu Lal Singh and other family members. The informant had a belief that accused persons have killed her son.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.38833 of 2025(3) dt.14-08-2025 2/3 petitioner is innocent and has been falsely implicated in this case due to dirty village politics and previous enmity. There is no eye witness and nothing has been recovered from possession of the petitioner. Petitioner is a student. It is further submitted that similarly situated co-accused persons, namely, Chhathulal Singh, Sonamati Devi and Manoj Kumar Singh @ Manoj Kumar have already been granted regular/anticipatory bail by a Coordinate Bench of this Court vide orders dated 06.02.2025, 19.03.2025 and 10.01.2025 in Cr.Misc.No.74865 of 2024, Cr.Misc.No.4041 of 2025 and Cr.Misc.No.68492 of 2024 respectively. Petitioner has one criminal antecedent in which he is on bail. Charge sheet has already been submitted and there is no chance of his absconding or tampering with the evidence. Petitioner surrendered suo motu and is in custody since 30.04.2025 and he undertakes to cooperate in the trial.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.
6. Having considered the above facts and circumstances of the case as well as the submissions of learned counsels for the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the
Patna High Court CR. MISC. No.38833 of 2025(3) dt.14-08-2025 3/3 satisfaction of learned A.D.J. VIII at Buxar in connection with Rajpur P.S. Case No.194 of 2024.
