JUSTICE BIRENDRA KUMAR ORAL ORDER 19-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 149/323/341/307/504 of the Indian Penal Code and Section 27 of the Arms Act. Allegation against the petitioner is that for land dispute the petitioner had fired causing injury at the front of neck of Sanjay Paswan, the son of the informant.

Submission is that the petitioner is in custody since 02.07.2016. This Court had earlier refused the prayer for bail vide order 14.12.2016, passed in Cr. Misc. No.45765 of 2016 with liberty to the petitioner to renew the prayer after six months if the trial is not expedited. The petitioner has stated on oath that the

Patna High Court Cr.Misc. No.29089 of 2017 (2) dt.19-07-2017 2/2 case was committed to the Court of Sessions and registered as Sessions Trial No.277 of 2017. However, no progress in the trial has taken place.

Considering the nature of allegation and the period already undergone by the petitioner, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII, Patna City, Patna/Successor Court, in connection with S.T. No.277 of 2017, arising out of Shahjahanpur P.S. Case No.26 of 2016, with condition that petitioner shall fully cooperate with the trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
