JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Gopalpur P.S. Case No. 104 of 2018 registered for the offences punishable under Sections 363 and 366A/34 of the Indian Penal Code.

Allegation as per FIR against the petitioner is of kidnapping of minor daughter of the informant. Submission of learned counsel for the petitioner is that as a matter of fact they have solemnized marriage and are residing together and further submission is that though it is alleged that she is minor but she was allowed to reside with the petitioner.

Heard learned APP also.

In view of above facts and circumstances, this

Patna High Court CR. MISC. No.38210 of 2019(4) dt.25-09-2019 2/2 application is disposed of with direction to the petitioner to surrender on 16.10.2019 along with the victim girl in court and the court below shall verify the above submission of petitioner from the girl that she has married with the petitioner and on such verification petitioner shall be released on bail by the court below to its own satisfaction.
