JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-04-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 147,148,149,341,342,323,324,307,504, 379 of the Indian Penal Code and Section 27 of the Arms Act.

From the First Information Report it appears that the date of occurrence is 1.8.2014 for which the First Information Report was instituted on 4.8.2014.

Learned counsel for the petitioners has submitted that for

Patna High Court Cr.Misc. No.48677 of 2014 (2) dt.30-04-2015 the said occurrence which had taken place on 1.8.2014, mother of petitioner no.4 Ramesh Kumar Singh had instituted an FIR being Magadh Medical P.S. case No. 104 of 2014. He contends that the present Magadh Medical P.S. case no. 107 of 2014 registered on 4.8.2014 is a counter blast to the earlier case instituted by the mother of petitioner no.4. The petitioners belong to the same family and it has been stated that they have no criminal antecedent.

In view of the submission as above, let petitioners above named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Magadh Medical P.S. Case No. 107/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
