JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code and Section 27 of the Arms Act. Petitioner was, allegedly, arrested when he along with others had assembled to explode bombs with an intent to terrorize the local people but admittedly, nothing has been recovered from conscious possession of the petitioner nor petitioner does have any criminal antecedent, which is evident from perusal of para-3 of the petition.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.31819 of 2016 (2) dt.18-08-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran in connection with Chhauradano P.S. Case No. 38 of 2016.
