2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 317(5) of the Bharatiya Nyaya Sanhita and Section 30(a) of Bihar Prohibition and Excise Act.

3. As per prosecution case, 17 liters illicit liquor was recovered from the seized motorcycle bearing registration no. BR04P5996.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner. He has been made accused in this case only on suspicion. Petitioner is neither driver nor owner of the vehicle in question.

5. Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.40283 of 2025(2) dt.26-06-2025 2/2 bail and submits that the petitioner has got three criminal antecedents out of which two are of similar nature.

6. Considering the quantity of recovery and criminal antecedents of similar nature, prayer for anticipatory bail of the petitioner is refused.
