JUSTICE SHIVAJI PANDEY ORAL ORDER 28-10-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case instituted for the offences under Sections 302/34 of the Indian Penal Code. Two First Information Reports were filed for one incident, Hathauri P.S. Case No.26 of 2015 was filed under Section 302/34 of the Indian Penal Code and another Complaint Case No. 621 of 2015 was also filed. At one side the son of the victim has lodged the FIR against his own maternal grand-father, namely, Shankar Sahni, whereas Sanker Sahni has filed a complaint against his son-in-law making allegation and counter allegation for the death of the victim. During investigation the evidence shows that

Patna High Court Cr.Misc. No.39431 of 2016 (3) dt.28-10-2016 conflicting statement has been recorded as it has come that she has committed suicide on account of family dispute with the husband. Further it has come that husband has killed the victim.

Having considered the facts and circumstances of the case, let petitioner, Baidyanath Sahni, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Muzffarpur in connection with Hathauri P.S. Case No.26 of 2015, S.T. No.388 of 2016.
