The petitioners seek bail in a case instituted for the offences under Sections 302/34 of the Indian Penal Code but charge-sheet has been submitted under section 304(B) IPC. Allegation against the petitioners is of committing torture and assault and thereafter caused death of the victim due to non-fulfilment of demand of dowry.

It has been submitted on behalf of the petitioner that the petitioner nos. 1 and 2 are in custody since 26.3.2019 while petitioner no. 3 is in custody since 14.3.2019 and they have got

Patna High Court CR. MISC. No.39262 of 2019(2) dt.02-07-2019 2/2 no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Charge-sheet has been submitted in the present case. The petitioners have falsely been implicated in the present case due to petty family dispute. The petitioners are in-laws. They are separate in mess and property from the husband of the deceased. They have got no concern with the alleged occurrence. The husband of the deceased is in custody.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Madhubani in connection with Deodha P.S. Case No. 26 of 2019.
