2. The petitioner seeks bail in a case registered for offence under Sections 103(1), 61(2), 3(5) of the B.N.S., 2023 and Section 27 of the Arms Act.
3. The prosecution case, in brief, is that on 10.07.2024 at 07:30 P.M., informant's husband Bhawesh Yadav along with his four friends left on a bike to attend a marriage ceremony. After attending the wedding, he told the informant on mobile phone that he was going to Ajay's place. At 10 pm, some villagers informed that Bhavesh has been shot and thereafter, informant went to the spot and saw dead-body of her husband, lying on the ground and soaked in blood. The accused surrounded Bhavesh Yadav on the road in front of Ajay Yadav's house and shot him, due to which, he died on the spot. The informant claims that Vipin Yadav, Ashish Kumar, Chhotu Kumar and 3-4 other persons have killed her husband due to an old dispute.
4. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. Name of the petitioner surfaced during course of investigation Petitioner has got clean antecedent and is in custody since 10.04.2025. Chargesheet has been submitted. Similarly situated co-accused persons namely Ashish Kumar and Bipin Kumar have already been granted anticipatory bail by this Court, vide order dated 05.02.2025 passed in Cr.Misc. No. 83317 of 2024 with Cr.Misc. No. 84058 of 2024 (Annexure P/2).
5. Learned A.P.P. for the State vehemently opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Araria in connection with
