The petitioner apprehends arrest in Kotwali P.S. Case No. 177 of 2014 dated 16.06.2014 instituted under Sections 426/467/468/471/34 of the Indian Penal Code. The allegation against the petitioner is that he had inspired Rajiv Srivastav, who has got eight bank accounts opened in which the mobile number was the same, leading to suspicion. Learned counsel for the petitioner submits that the bank accounts were not in his name and further he has no connection with Rajiv Srivastav and the allegation against him is false.
Learned A.P.P.
opposes the prayer for anticipatory bail and submits that the petitioner had managed to slip away from the bank and only Rajiv Srivastav was caught and it has come during investigation that the petitioner
Patna High Court Cr.Misc. No.47353 of 2014 (2) dt.30-04-2015 2/2 had gone to the persons in whose names the accounts were opened and after giving them Rs. 400 had taken two photographs from them and got the said accounts opened. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, the Court is not inclined to enlarge the petitioner on anticipatory bail.
The application, accordingly, stands dismissed. However, in the event the petitioner surrenders and prays for regular bail before the Court below, the same shall be considered on its own merits in accordance with law without being prejudiced by the present order.
