JUSTICE SUDHIR SINGH ORAL ORDER 05-12-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302/34 of the Indian Penal Code.

Allegation against petitioner is that he along with other accused persons had killed son of the informant due to dispute with regard to love affair.

It has been submitted on behalf of petitioner that he is in custody since 1.7.2016. Chargesheet has been submitted against petitioner for the offence under Section 306 of the Indian Penal Code. It is not a case of homicidal amounting to murder. It is a case of suicide. There is no other substantive evidence to suggest implication of the petitioner in the present case. It is a case of love affair between the deceased and Guriya Kumari, daughter of Bhuteli Bhagat.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.51284 of 2016 (2) dt.05-12-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Chakiya P.S. Case no. 123 of 2016.
