JUSTICE BIRENDRA KUMAR ORAL ORDER 14-08-2018 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are in custody in connection with Pipra P.S. Case No.58 of 2017, a case under Section 366A/34 of the Indian Penal Code.

The petitioners are full-brother and father, respectively, of co-accused Shrawan Kumar. Though allegation of kidnapping is there against Shrawan Kumar and the petitioners. However, perusal of the entire statement of the victim recorded under Section 164 Cr.P.C., at Annexure-3, and the statement of the victim recorded in connection with Maheshi P.S. Case No.127 of 2017, at Annexure-B, would reveal that this one may be a case of one-sided love between the victim and co-accused Shrawan

Patna High Court Cr.Misc. No.33770 of 2018 (4) dt.14-08-2018 P2/ Kumar. Subsequently, the victim was married with another boy Vikash Kumar on 25.05.2017 prior to her statement recorded in Maheshi P.S. Case No.127 of 2017.

Learned counsel for the informant opposed the prayer for bail.

Considering the aforesaid facts as well as considering the completion of investigation against the petitioners and statement of the petitioners on oath that they have got no criminal antecedent, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Pipra Police Station Case No.58 of 2017, with condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
