JUSTICE BIRENDRA KUMAR ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is in custody in Itarhi P.S. Case no.101 of 2016 registered for the offences under Section 302/34 of the I.P.C. and Section 27 of the Arms Act.

The petitioner was member of unlawful assembly. The specific allegation of firing is against the co-accused Shera Hussain who shot at the uncle and aunty of the informant as a result of which both died.

Submission of the petitioner is that he has no criminal antecedent and on account of village politics has been arrayed as an accused.

Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.50720 of 2016 (2) dt.22-12-2016 2/2 the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the A.C.J.M. -II, Buxar at Chapra, in Itarhi P.S.Case No.101/16.
