JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-06-2019 Petitioner seeks bail in anticipation of his arrest in connection with Khagaria (Gangaur) P.S. Case No. 195 of 2019 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 506, 379, 342, 120B, 307 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the accused persons, including the petitioner is that they came and surrounded the informant and petitioner caught hold of the collar of his shirt and other accused persons assaulted him. Further allegation is that he snatched the mobile phone of the informant.

Submission of learned counsel for the petitioner is that there is case and counter case between the parties, which will appear from Annexure-2 and there is no specific allegation of assault against the petitioner and FIR itself shows that there is

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Khagaria (Gangaur) P.S. Case No. 195 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
