2. The petitioner seeks bail in connection with Sanokhar P.S. Case No. 186 of 2023 registered for the offence under Sections 302, 201, 34 of the IPC.
3. As per the prosecution case, during investigation, it has come that the deceased had committed suicide and the petitioner is the husband of the deceased.
4. Learned counsel for the petitioner submits that there are five children staying with the family of the petitioner and the petitioner is in jail since 05.10.2023.
5. Considering the aforesaid facts, this application for regular bail is allowed.
6. Let the petitioner, above named, be released on
Patna High Court CR. MISC. No.44830 of 2024(2) dt.20-07-2024 2/2 bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge X cum incharge Sessions Judge-X, Bhagalpur in connection with Sanokhar P.S. Case No. 186 of 2023.
7. At the time of acceptance of bail bond, the trial Court will verify the fact that as to whether the children are staying with the family of the petitioner or not. If the children are found staying with the family of the petitioner, the petitioner's bail bond shall be accepted. If the children of the petitioner are not found staying with the petitioner, the bail bond shall not be accepted.
