Petitioner is languishing in custody since 02.09.2016 in connection with Buxar (T) P.S. Case No. 382 of 2016 for offences punishable under Sections 326, 302, 406/34 of the Indian Penal Code as well as Section 27 of the Arms Act. The husband of the informant was a land dealer. He had advanced money to the named accused persons thereafter the husband was demanding refund of the same. Allegation is that for that dispute murder of the husband was committed by some unknown person.
Submission of the petitioner is that co-accused Santosh Paswan had confessed that he had committed murder of the deceased and he has named his associates including the
Patna High Court Cr.Misc. No.51823 of 2016 (2) dt.30-11-2016 2/2 petitioner.
Considering the fact that only material against the petitioner is the confessional statement of co-accused, namely, Santosh Paswan before the police as well as criminal antecedent of the petitioner stated in paragraph 3 of the bail petition which reveals that petitioner is accused in two other cases of trivial nature, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (T) P.S. Case No. 382 of 2016.
