The petitioners apprehend their arrest in connection with Basopatti P.S. Case No. 24 of 2015 registered for the offences punishable under Sections 341, 323, 324, 354/34 of the Indian Penal Code and Section 3(x) of SC/ST Act. Learned counsel for the petitioner submits that the entire case is false and fabricated and the provision of SC/ST has been brought mischievously only to make the offence graver though there is no whisper in the entire first information report. It is further submitted that regarding using his caste name no other witness came forward to support the allegation made in the FIR.
Considering the aforesaid submissions and the petty nature of the charges leveled against the petitioners, let
Patna High Court Cr.Misc. No.30342 of 2015 (2) dt.06-08-2015 the petitioners above named, in the event of their arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Madhubani in connection with Basopatti P.S. Case No. 24 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C.
