JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-11-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 273/34 of the Indian Penal Code and Section 47 of Bihar Excise (Amendment) Act, 2016. Near about 180 bottles containing 123 litres Indian made foreign liquor are said to have been recovered from the house of the petitioners for which petitioners were arrested and are languishing in jail custody since 20.06.2016. Submission on behalf of the petitioners is that the aforesaid recovery is said to have been made from joint house and, therefore, petitioners deserve privilege of bail. Moreover,

Patna High Court Cr.Misc. No.39207 of 2016 (3) dt.17-11-2016 2/2 petitioners do not have any criminal antecedent and the investigation against them appears to have already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Araria in connection with Tarabari P.S. Case No. 51 of 2016.
