Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Three unknown criminals committed firearm injury and murder of Dharamveer Singh an employee at the business premise of the informant. Co-accused Prem Ranjan Singh was apprehended and he confessed before the police disclosing the name of this petitioner also.

Submission is that Prem Ranjan Singh has already been allowed bail by a Coordinate Bench of this Court vide order dated 10.01.2017 passed in Cr. Misc. No. 49360 of 2016 and co-accused Sudhir Kumar Singh @ Munna Singh was

Patna High Court Cr.Misc. No.25020 of 2017 (3) dt.29-06-2017 2/2 allowed bail vide order dated 22.12.2016 passed in Cr. Misc. No. 51010 of 2016 by different Coordinate Benches of this Court. Allegation against the petitioner is of similar footing. Considering the fact that similarly situated other co-accused have already been allowed bail by a Coordinate Bench of this Court, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sitamarhi/successor Court in connection with Majorganj Police Station Case No. 159 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
