The petitioner, who is in custody, seeks bail in connection with Ahiyapur P.S. Case No. 10 of 2017 registered for the offence punishable under Sections 457, 380, 411 of the Indian Penal Code.

Informant in his written complaint has stated that on 01.01.2017 when he returned to his house after treatment in P.G.I., Lucknow he found the lock to be broken and household articles were stolen by unidentified thieves. When he went to the police station to lodge FIR, he found that his household articles were kept on a tempo standing in the police station, when the owner of the tempo was contacted it was

Patna High Court Cr.Misc. No.35492 of 2018(4) dt.18-08-2018 2/2 alleged that owner and driver of the tempo had stolen his household articles by breaking open his house. During investigation, the owner of the tempo named petitioner that he had given tempo to ply on daily wages and on basis of such statement, petitioner was apprehended.

It has been submitted on behalf of the petitioner that petitioner is innocent and has been falsely implicated by the owner of the tempo as he has some dispute with his family members. It has further been submitted that petitioner is in custody since 28.03.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-15-cum-learned A.C.J.M., Muzaffarpu, in connection with Ahiyapur P.S.
