2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a), 37(b), 37(c) of the Bihar Prohibition and Excise Act.
3. As per prosecution case, 25 litres illicit liquor was recovered from the seized six-wheeler tanker bearing registration no. NL04D0954 along with one Scorpio car of which this petitioner is registered owner.
4. Learned counsel for the petitioner submits that no incriminating material has been recovered either from conscious possession of the petitioner or from the seized Scorpio car of this petitioner. Petitioner has got no concern with the alleged recovery and he has been made accused merely because his vehicle was seized from the place of occurrence. Petitioner has

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Court No. 1, Aurangabad in connection with Madanpur P. S. Case No. 268 of 2019, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) Navya/- U T
