JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

It is alleged that the petitioner being Incharge Headmaster had been given Rs.8,59,500/- for construction purposes. Subsequently the petitioner did not start construction work though returned the amount except Rs.1,75,000/-. It is submitted by the learned counsel for the petitioner that the petitioner is ready to deposit Rs.1,75,000/- before the concerned authorities.

On producing receipt of deposit of Rs.1,75,000/- before the concerned authority, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender

Patna High Court Cr.Misc. No.31613 of 2015 (2) dt.05-08-2015 2/2 before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Rajpur P.S. Case No.129 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
