JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-10-2018 The petitioner seeks regular bail in connection with Chiraiya P.S. Case No. 180 of 2017, registered for offences punishable under Sections 386 of Indian Penal Code. Allegation against the petitioner is of demand of extortion of Rs. 25 lacs from the informant.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case only on the confession of co-accused and further the mobile phone, which has been used for demand of extortion does not belong to the petitioner. It has also been submitted that petitioner has been in judicial custody since 27.07.2017 and the co-accused on whose confession, the name of the petitioner surfaced, has already been enlarged on bail by a coordinate Bench of this Court vide order dated 17.05.2018 passed

No. 17.05.2018 Learned counsel for the State opposed the prayer for bail and submitted that the petitioner has criminal antecedent as he is accused in seven other cases and most of them are similar in nature as the present one.

Having heard both sides, considering the fact and circumstances of the case as well as the criminal antecedents of the petitioner, I am not inclined to release the petitioner on bail, This application is, accordingly, rejected.

However, the trial court is directed to expedite the trial. (Vinod Kumar Sinha, J) sunil/- U T
