The petitioner seeks regular bail in connection with Patory (Mohanpur O.P.) P.S. Case No. 37 of 2017, registered for the offences punishable under sections 304B, 201/34 of the Indian Penal Code.

Allegation against the petitioner who is said to be mother in law of the deceased is that she along with other accused have demanded the dowry and subjected to cruelty.

Submission of learned counsel for the petitioner is that the allegation is general and omnibus in nature and furthermore petitioner is a lady and she is in custody for six months. Considering the facts and circumstances of the case, let

Patna High Court Cr.Misc. No.29437 of 2017 (3) dt.18-07-2017 the petitioner Binda Devi be released on bail on furnishing bail bonds of Rs. 25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Patory (Mohanpur O.P.) P.S. Case No. 37 of 2017 subject to the conditions that:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable properties within the jurisdiction of the concerned Court;

(ii) The petitioner will not induce any witness or tamper with the evidence; and (iii) The petitioner shall cooperate in the disposal of the trial and make herself available as and when required by the court and on the event of failure on her part to appear before the court below on two consecutive dates without showing any genuine reason, the prosecution is free to move for cancellation of her bail.
