The petitioner is in custody since 26.09.2017 in connection with Jankinagar P.S. Case No. 168 of 2017 for the offence registered under Section 302 of the Indian Penal Code. Learned counsel for the petitioner submits that though the petitioner is not named in the first information report, subsequently, on the basis of the confessional statement made before the police by the father of the deceased lady, namely, Dinesh Mandal, the name of the petitioner transpired and he has been taken into custody. It is further submitted that the said confessional statement made before the police has no evidentiary value and even the said Dinesh Mandal has since been extended the privilege of bail vide order dated 29.05.2018 passed in Cr.

Patna High Court Cr.Misc. No.35604 of 2018 (4) dt.08-08-2018 Misc. No. 26534 of 2018.

Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Purnia in connection with Jankinagar P.S.
