2. The petitioner apprehends her arrest in a case, registered for offence punishable under Sections 379, 420 of the Indian Penal Code and 66(D) of I.T. Act, 2000.
3. As per F.I.R., the informant filled an On-line Form for grant of franchise of Tata IMG and thereafter, he received a call from one Durgesh Sharma, who asked him to deposit Rs.15,000/- for registration and accordingly, the informant deposited the amount in the account provided by said person from the account of his wife Jyoti Hisariya through NEFT. Thereafter, informant sent the Aadhaar Card, PAN Card, Photo and Email of his wife for identification and sent the same through his email on the email address "Support@TataIMG
Patna High Court CR. MISC. No.47819 of 2025(3) dt.01-09-2025 2/3 franchises.com". It is further alleged that afterwards two more persons called the informant and asked to deposit Rs.3,40,400/- on installment on the pretext of agreement, to which informant deposited in the account on different dates in installment, but on suspicion, the informant checked the account numbers, in which he deposited money, in the concerned Central Bank and found that the said account number belongs to one Shila Kumari (petitioner herein) and there was no reference of being connected with Tata IMG. Thus, this petitioner alongwith other co-accused persons, named in the F.I.R., cheated the informant.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. She herself has been cheated by one Md. Adil, who in the name of providing loan to her, got her all documents including bank account number and provided the same to other F.I.R. named accused persons, who used her bank account in the present cyber fraud. Petitioner is unemployed lady and has got no concern with this crime.
5. Learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail and submits that petitioner is named in F.I.R. with specific accusation that entire amount was credited in her bank account.
