JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Shastri Nagar P.S. Case No. 131 of 2017 registered for offences punishable under Sections 290, 294, 420/34 of Indian Penal Code and Sections 3, 4, 5, 6, 7, 8 and 9 of Immoral Traffic (Prevention Act).
Allegation against the petitioner as per F.I.R. is that he along with other accused persons was involved in illegal trafficking and they were apprehended from the spot in objectionable condition.
It has been submitted on behalf of the petitioner that petitioner is of clean antecedent and petitioner is a driver and
Patna High Court Cr.Misc. No.21421 of 2017 (4) dt.20-06-2017 2/2 owner of the vehicle and is working as a driver in the office of Balaji Star Plus Channel and he was going to his residence. It has further been submitted that petitioner remained in custody for more than three months.
Heard learned A.P.P. also and stated that petitioner was arrested at the spot and he was involved in collecting money from the girls who had received the same from the clients and, as such, there is clear allegation against the petitioner. Having heard both sides, there is direct allegation against the petitioner and, as such, I am not inclined to release the petitioner on bail, his application for grant of regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial and try to conclude it as soon as possible preferably within a period of six months from today. At the same time Superintendent of Police, Patna is directed to ensure the attendance of witnesses in the court on the date fixed so that the trial can be concluded expeditiously.
