JUSTICE SUDHIR SINGH ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 420, 471 and 406/34 of the Indian Penal Code. Allegation is that on allurement of petitioner and other accused persons, informant invested Rs.60 lacs in construction project and subsequently, they disappeared with the money and cheated informant.

It has been submitted on behalf of the petitioner that he is in custody since 24.5.2015. Chargesheet has been submitted against the petitioner. No allegation of tampering of witnesses is alleged against the petitioner. There is no chit of paper produced by the prosecution to show that there was any money transaction between the petitioner and the informant. Hence, no wrongful loss to the informant has been caused by the petitioner nor wrongful gain has been made by the petitioner.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.26073 of 2016 (3) dt.17-08-2016 2/2 above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali (Barari) P.S. Case no. 265 of 2014.
