2. The petitioner is named in the F.I.R. and apprehending his arrest in connection with Maner P.S. Case No. 207 of 2026 registered for the offences punishable under Sections 126(2), 127(2), 74, 75, 76, 115(2), 79, 352, 3(5) of BNS and u/s 8 and 12 of POCSO Act.

3. The allegation against petitioner is to sexually assault the informant and her younger sister aged about 16 years when they went to attend the call of nature to one adjacent field of their house.

4. It is submitted by learned counsel appearing on behalf of the petitioner that in fact the minor sister of the informant was in talking terms with petitioner and when the

Patna High Court CR. MISC. No.41175 of 2026(2) dt.29-06-2026 2/2 family members of the informant pressurized the petitioner to marry, which was referred by him, thereafter, the present false case was lodged against this petitioner. Petitioner claimed clean antecedent.

5. Learned APP while opposing the prayer of bail submitted that the occurrence was duly supported by minor victim aged about 16 years, who is the younger sister of the informant, while recording her statement under Section 183 of BNSS, raising specific allegation against this petitioner. It is submitted that submission qua proposal of marriage is an afterthought as no such material surfaced during investigation till now.

In view of aforesaid factual submission and by taking note of fact as specific allegation qua sexual assault to the minor younger sister of the informant is available against this petitioner which is duly supported through her statement recorded under Section 183 of BNSS, accordingly, the prayer of anticipatory bail of petitioner stands rejected.
