ANJANA MISHRA ORAL ORDER 12-08-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in connection with Taraiya P.S. Case No. 17 of 2015 registered for the offences punishable under Section 272 and 273 of the Indian Penal Code and Section 47(A) of the Excise Act. Learned counsel for the petitioner submits that petitioner is a Truck owner from which the certain excise articles are said to have been recovered. It is further submitted that it is only the driver who takes the vehicle and let it on hire to parties, in question. It is further submitted that whatever recovery was made from his truck was not to his knowledge. It is further submitted that petitioner has no criminal antecedent especially of similar nature.

Considering the aforesaid submissions, let the petitioner, in the event of his arrest or surrender before the

No.30795 of 2015 (2) dt.12-08-2015 Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Saran at Chapra in connection with Taraiya P.S. Case No. 17 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr. P.C. (Anjana Mishra, J) Jagdish/- U
