The petitioner apprehends arrest in a case registered for the offence punishable under sections 420/34 and other ancillary sections of the Indian Penal Code.
Prosecution case is that this petitioner purchased two katha land from the daughter of the informant without any family partition and demarcation of share and right. Learned counsel for the petitioner submits that the petitioner is bona fide purchaser of the land after making payment of due consideration money to the daughter of the informant. Two title suits are also pending between the informant and his family members for partition of the land in question in which petitioner has not been made party. Patna High Court CR. MISC. No.40835 of 2022(2) dt.28-11-2022 2/2 nature of dispute, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IX, Bhagalpur in Lodipur Police Station Case No. 12 of 2018, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
