2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 329(2), 109(1), 74, 303(2) and 3(5) of the B.N.S..
3. As per prosecution case, it is alleged that on 19.11.2025, all the F.I.R. named accused persons, including these petitioners, variously armed, came to the house of informant and started abusing him. It is further alleged that upon protest, all the accused persons assaulted informant and his family members. It is specifically alleged that co-accused
Patna High Court CR. MISC. No.40261 of 2026(2) dt.29-06-2026 2/3 Vivekanand Singh assaulted on the left hand of informant with sword, outraged the modesty of Gunjan Devi and Pinky Devi and stone gold Mangalsutra from the neck of Gunjan Devi.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. As a matter of fact, both parties are Gotiyas and on account of petty dispute, a free-fight took place between the parties in which both sides sustained injuries. There is case and counter-case. From bare perusal of the F.I.R. it is apparent that specific accusation of assaulting informant with sword, outraging the modesty of female member of the family and snatching gold ornament is against co-accused Vivekanand Singh. So far as these petitioners are concerned, there is general and omnibus nature of accusation and no specific allegation of overt act has been levelled against them. Petitioners claim clean antecedents.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the facts and circumstances of the case, general and omnibus nature of accusation, case and counter-case between the parties and clean antecedents of the
Patna High Court CR. MISC. No.40261 of 2026(2) dt.29-06-2026 3/3 petitioners, the prayer for grant of anticipatory bail to the petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Amarpur P.S. Case No. 832 of 2025, subject to condition as laid down under Section 482(2) of the B.N.S.S.. (Prabhat Kumar Singh, J) shashank/- U T
