Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 414, 420, 120B of the Indian Penal Code and Section 4/5 of the Explosive Substances Act.

On suspicion three persons were apprehended and on their disclosure huge quantity of explosive were recovered. They disclosed the name of several persons including the petitioner who are involved in storage of explosives.

It is submitted by learned counsel for the petitioner that recovery was not made from the petitioner nor it was a case that petitioner was present at the place of seizure. A statement has been made in para 3 of the

Patna High Court Cr.Misc. No.32558 of 2015 (2) dt.10-08-2015 2/2 petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sasaram(M) P.S. Case No. 821 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The bail bonds of the petitioner will be accepted on filing affidavit that he will cooperate in the investigation. Non-cooperation in the investigation will give liberty to the prosecution to file appropriate application for cancellation of bail of the petitioner.
