JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-386, 387, 307/34 of the Indian Penal Code and under Sections-25(i-B)A/26/27/35 of the Arms Act.

The case of the petitioner stands on similar footing to that of co-accused Pawan Mandal, who has already been granted privilege of bail by this court vide order dated 07-09-2016 passed in Cr. Misc. No. 23597 of 2016.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kasim Bazar P.S. Case No. 14 of 2015 to the satisfaction of

No.36964 of 2016 (3) dt.15-09-2016 2/2 learned Chief Judicial Magistrate, Munger subject to condition that any attempt, on behalf of or by the petitioner, to terrorize the prosecution witness, shall give liberty to the trial court to cancel the bail bonds of the petitioner after due and proper inquiry.
