Petitioners seeks bail in Sanokhar P.S. Case No. 02 of 2018 registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code. Informant in his written report has stated that on 02.01.2018 at about 4:00 pm when Randhir Singh (deceased) alongwith Vivekanand Singh @ Guddu Singh and Dhiraj Kumar Bharti went to sell the fish at village

Patna High Court Cr.Misc. No.38159 of 2018(4) dt.23-08-2018 2/3 Jafra then the petitioner along with other co-accused persons caught Randhir Singh. Vivekanand Singh @ Guddu Singh and Dhiraj Kumar Bharti fled away from there and narrated the whole story to the informant upon which informant along with them reached village Jafara searching his brother where he was informed that Randhir Kumar Singh (deceased) went from there and thereafter the dead body of Randhir Kumar Singh (deceased) was recovered from the bank of Chonha river near village Jafara. It has been submitted on behalf of the petitioners that they are innocent and have been falsely implicated in this case due to village politics. It has been further submitted that the present case has been lodged after recovery of the dead body of the deceased and prior to the occurrence no complaint was made before the police by the informant. Petitioners have got no criminal antecedent and are in custody since 05.01.2018.

Considering the fact that the petitioner no. 2 is a lady and has got no criminal antecedent, let the petitioner no. 2 be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the

So far as petitioner no. 1 is concerned, his prayer for bail is hereby rejected.
