JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 01-04-2022 At the very outset, learned counsel for the petitioners seeks permission to withdraw the petition of petitioner no.1, namely, Sakaldeo Yadav @ Sako Yadav.

Permission is accorded.

Accordingly, the petition of petitioner no.1, namely, Sakaldeo Yadav @ Sako Yadav is dismissed as withdrawn. Heard learned counsel for the petitioner no.2 and learned APP for the State.

The petitioner no.2 is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 308 and 504 of the Indian Penal Code. It is a case of assault upon the informant on his head

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner no.2 only caught hold of the informant and no specific allegation of overt-act against him. Petitioner has got clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

In the facts and circumstances of the case, let the petitioner no.2, namely, Subhash Yadav @ Subash Yadav, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Jamui/ concerned Court in connection with Sono P.S. Case No. 106 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sunil Kumar Panwar, J) Brajesh Kumar/- U T
