This application is filed for grant of regular bail in connection with Laxmipur P.S. Case No. 387 of 2021 registered under section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Prosecution story in short is that the petitioner along with others have shot dead the deceased.
It has been submitted by the learned senior counsel for the petitioner that the deceased was himself was having criminal antecedents and the petitioner has been falsely implicated as before the occurrence, the petitioner himself was
Patna High Court CR. MISC. No. 42440 of 2023(2) dt.14-07-2023 2/2 shot by gang of the informant's husband and had sustained ten bullet injuries and was treated in Paras Hospital, Patna and he is in custody since 21.12.2022.
Learned A.P.P. has vehemently opposed the prayer for bail.
Considering the period of custody, this application for regular bail is allowed.
Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Laxmipur P.S. Case No. 387 of 2021.
The petitioner is directed to cooperate in the trial. If the petitioner does not cooperate in the trial, the Court below is at liberty to cancel the bail bonds of the petitioner. (Sandeep Kumar, J) Sunnykr/- U T
