====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 20-04-2022 Heard learned counsel appearing on behalf of the petitioner and learned APP for the State.

Let the defect(s) be removed within two weeks of the complete start of the physical Court in normal course. Petitioner, who is in custody since 24.04.2020, seeks regular bail in connection with Suiya P.S. Case No. 26 of 2020 registered for offences punishable under Sections 302/120-B/34 of the Indian Penal Code and Section 27 of the Arms Act. The allegation against the petitioner is that he along with other co-accused person in a planned manner surrounded the son of the informant and the present petitioner, by means of fire-arm assaulted the son of the informant as a result of which, he succumbed to injuries.

Taking into consideration the gravity of offence, I am

Patna High Court CR. MISC. No.50554 of 2021(4) dt.20-04-2022 2/2 not inclined to enlarge the petitioner on bail. The learned trial Court is directed to expedite the trial and conclude the same preferably within a period of fifteen months.

If no substantial progress takes place in conduct of trial, the petitioner, if so advised, may renew his prayer for bail after the aforesaid period.

Superintendent of Police, Banka, is directed to produce all the prosecution witnesses on the date fixed by the trial Court without fail.

A copy of this order may be communicated to the Superintendent of Police, Banka.

With the above observation, the present bail application is dismissed.
