JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-07-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a complaint case in which process has been directed to be issued after cognizance being taken for the offences punishable under Sections 341,342,323,379 and 386 of the Indian Penal Code. The prosecution case is of making assault, snatching gold chain, Mangal sutra, cash of Rs.6200/-, wrist watch and obtaining signature on blank paper of the brother in law of the complainant.
It is submitted by the learned counsel for the petitioners that the present anticipatory bail has been filed after issuance of
Patna High Court Cr.Misc. No.25430 of 2014 (6) dt.31-07-2015 2/2 warrant by the learned court below. It is further submitted that petitioner no. 1 lodged Warisnagar P.S. Case No. 108 of 2011 against the complainant and others on 19.5.2011 making accusation under sections 341,323,354 and 504/34 IPC, thereafter the present complaint was filed on 21.5.2011. Statement has been made in paragraph 9 of the petition that none has received injury. Considering the case lodged by the petitioners side at earlier point of time and none received injury, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Samastipur in connection with Complaint Case No. 585 of 2011 subject to the conditions as laid down under Section 438(2) Cr.P.C.
